Welcome to Lainie! These Terms of Service ("Terms") govern your access to and use of the Lainie mobile application ("App," "Service," or "Lainie"), provided by Marar Ventures. By downloading, accessing, or using Lainie, you agree to be bound by these Terms.
Important: Please read these Terms carefully before using Lainie. If you do not agree to these Terms, do not use our Service. Your continued use of the Service constitutes acceptance of these Terms.
1. Acceptance of Terms
By creating an account or using Lainie, you confirm that:
- You are at least 13 years of age (in compliance with COPPA - Children's Online Privacy Protection Act)
- You have the legal capacity to enter into these Terms
- You will comply with these Terms and all applicable laws
- All information you provide is accurate and truthful
- You understand that Lainie uses artificial intelligence and may produce inaccurate or inappropriate responses
Age Verification: During onboarding, you will be asked to provide your age. Users under 13 years old are not permitted to use Lainie and will be automatically signed out if they indicate they are under 13. This is required for compliance with the Children's Online Privacy Protection Act (COPPA).
2. Description of Service
Lainie is an AI-powered chat companion application that provides conversational assistance. The Service includes:

- AI Chat: Natural language conversations powered by advanced AI models (Anthropic Claude and OpenAI GPT)
- Message History: Your conversations are saved to your account for continuity
- Multi-Device Access: Sign in from multiple devices with cloud synchronization
- Push Notifications: Optional notifications for important updates

Free Messages: You receive 50 free messages when you first create an account. Once used, you'll need to upgrade to Premium to continue chatting. Free message count is tracked per account, not per device.
2.3 AI Content Disclaimer
Important Disclaimer: Lainie uses artificial intelligence to generate responses. The AI may:
- Provide inaccurate, incomplete, or outdated information
- Generate inappropriate, offensive, or biased content despite our safeguards
- Misunderstand context or user intent
- Produce responses that are plausible-sounding but factually incorrect ("hallucinations")
Lainie is NOT a substitute for professional advice, therapy, counseling, medical diagnosis, legal counsel, or any other professional service. If you are experiencing a crisis, please contact qualified professionals or emergency services immediately (call 988 for the Suicide & Crisis Lifeline in the US).
3. User Accounts and Authentication
3.1 Account Creation
You can create a Lainie account using one of the following methods:
- Email & Password: Traditional account creation with your email address
- Sign in with Apple: OAuth authentication via your Apple ID
- Sign in with Google: OAuth authentication via your Google account
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access at support@hilainie.com
- Ensuring your email address is current and accessible
3.3 Account Termination
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- You engage in abusive, illegal, or harmful conduct
- You attempt to compromise the security or integrity of the Service
- We are required to do so by law
- We discontinue the Service (with reasonable notice)
4. Subscription Terms and Billing
4.1 Premium Subscription
Lainie Premium is a monthly subscription that provides unlimited access to the Service. Here are the complete terms:

4.2 Managing Your Subscription
To manage your Lainie Premium subscription:
- Open the Settings app on your iOS device
- Tap your name at the top
- Tap Subscriptions
- Select Lainie
- Choose to cancel or modify your subscription
4.3 Payment Processing
All payments are processed through:
- Apple App Store: Apple Inc. handles all payment processing and billing
- RevenueCat: Our subscription management platform (does not store payment information)
We do not have access to your payment card details. All payment disputes should be directed to Apple Support.
4.4 Price Changes
We reserve the right to change subscription prices at any time. Price changes will:
- Be communicated to you at least 30 days in advance via email or in-app notification
- Not affect your current billing period
- Apply to subsequent renewal periods unless you cancel
5. User Conduct and Acceptable Use
When using Lainie, you agree NOT to:
- Illegal Activity: Use the Service for any unlawful purpose or in violation of any applicable laws
- Harmful Content: Submit content that is abusive, threatening, defamatory, obscene, or promotes violence
- Impersonation: Impersonate any person or entity, or falsely represent your affiliation with anyone
- Security Violations: Attempt to gain unauthorized access, reverse engineer, or compromise the Service
- Automated Use: Use bots, scrapers, or automated systems to access the Service without permission
- Spam: Send unsolicited messages, promotional content, or spam
- Malicious Code: Upload viruses, malware, or any code designed to harm the Service or other users
- Data Mining: Collect or harvest user data without consent
- Service Disruption: Interfere with or disrupt the Service's operation or servers
Content Monitoring: While we do not actively monitor user conversations, we reserve the right to review content if we receive reports of abuse or illegal activity. Conversations may be used to improve our AI models (see our
Privacy Policy for details).
6. Intellectual Property Rights
6.1 Our Rights
All content and materials available through Lainie, including but not limited to:
- The Lainie name, logo, and branding
- App design, user interface, and layouts
- Software code, algorithms, and architecture
- Documentation and help materials
- AI model configurations and prompts
are owned by Marar Ventures and protected by copyright, trademark, patent, and other intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service without our explicit written permission.
6.2 Your Content and License
You retain ownership of the messages and content you submit to Lainie ("Your Content"). However, by using the Service, you grant us:
- A worldwide, non-exclusive, royalty-free license to use Your Content
- The right to process, store, and transmit Your Content to provide the Service
- The right to use anonymized and aggregated data to improve our AI models and Service
We will not sell your individual conversations or share them with third parties for marketing purposes (see our Privacy Policy for complete data handling practices).
6.3 Third-Party AI Models
Lainie uses AI models provided by:
- Anthropic: Claude AI models (subject to Anthropic's terms and policies)
- OpenAI: GPT models (subject to OpenAI's terms and policies)
When you use Lainie, your messages are sent to these third-party AI providers for processing. These providers have their own terms of service and privacy policies that govern their use of data.
7. Privacy and Data Protection
Your privacy is critically important to us. We collect, use, and protect your personal information as described in our Privacy Policy, which is incorporated into these Terms by reference.
7.1 Data We Collect
To provide the Service, we collect:
- Account Information: Email address, authentication tokens
- Chat Messages: Your conversations with Lainie
- Usage Data: Message count (for free tier limits), app activity, crash reports
- Device Information: Device ID, push notification tokens, OS version
7.2 Data Storage and Security
Your data is stored using:
- Supabase: Our backend-as-a-service provider for database, authentication, and file storage
- Encryption: All data is encrypted in transit (TLS/SSL) and at rest (AES-256)
- Access Controls: Strict role-based access controls limit who can access your data
7.3 Your Privacy Rights
You have the right to:
- Access: Request a copy of your data
- Deletion: Request deletion of your account and associated data
- Correction: Update or correct inaccurate information
- Export: Receive your chat history in a portable format

8. Disclaimers and Limitations of Liability
8.1 Service Provided "AS IS"
Lainie is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:
- Merchantability, fitness for a particular purpose, or non-infringement
- Accuracy, reliability, completeness, or timeliness of AI responses
- Uninterrupted, secure, or error-free operation
- Freedom from bugs, viruses, or harmful components
- Compatibility with your device or other software
8.2 AI Content Disclaimer
AI-generated responses are not guaranteed to be accurate, appropriate, or suitable for any purpose. You use AI responses at your own risk. We expressly disclaim all liability for:
- Reliance on AI-generated advice, suggestions, or information
- Inappropriate, offensive, or harmful content generated by the AI
- Actions taken based on AI responses
- Emotional distress, financial loss, or other harm resulting from AI interactions
8.3 Not Professional Services
Lainie does NOT provide professional services of any kind, including but not limited to:
- Medical Advice: Not a substitute for diagnosis, treatment, or medical care from licensed healthcare providers
- Mental Health Services: Not a replacement for therapy, counseling, or psychiatric treatment
- Legal Advice: Not a substitute for consultation with a qualified attorney
- Financial Advice: Not a replacement for professional financial planning or investment advice
- Emergency Services: Do not use Lainie in emergency situations - call 911 or your local emergency number
8.4 Limitation of Liability
To the maximum extent permitted by law, Marar Ventures and its officers, directors, employees, agents, and affiliates shall NOT be liable for any:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Personal injury, emotional distress, or relationship issues
- Property damage or financial loss
- Business interruption or loss of goodwill
arising from your use of or inability to use Lainie, even if we have been advised of the possibility of such damages.
Maximum Liability Cap: In any event, our total liability to you for all claims arising from these Terms or your use of Lainie shall not exceed the amount you paid us in the 12 months preceding the claim (or $100 USD if you have not paid us anything).
8.5 Third-Party Services
We are not responsible for:
- Third-party AI model responses (Anthropic, OpenAI)
- Apple App Store policies, payment processing, or refund decisions
- Supabase service availability or data handling
- OAuth provider (Apple, Google) authentication issues
- Push notification delivery via Apple Push Notification Service
9. Indemnification
You agree to indemnify, defend, and hold harmless Marar Ventures, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property or privacy rights
- Content you submit to the Service
- Your violation of any applicable laws or regulations
10. Modifications to the Service and Terms
10.1 Service Changes
We reserve the right to:
- Modify, update, or discontinue any aspect of Lainie at any time
- Change features, functionality, or user interface
- Add or remove AI model providers
- Adjust free tier limits or subscription pricing with notice
10.2 Terms Updates
We may update these Terms from time to time. When we make material changes:
- We will update the "Last Updated" date at the top of this page
- We will notify you via email or in-app notification
- You will have the opportunity to review the new Terms before they take effect
- Your continued use of the Service after changes constitutes acceptance
11. Account Termination and Data Deletion
11.1 Terminating Your Account
You may terminate your account at any time by:

- Your active subscription (if any) will be canceled (subject to Apple's refund policy)
- Your chat history and account data will be scheduled for deletion within 30 days
- Some data may be retained for legal compliance, fraud prevention, or analytics (anonymized)
11.3 Data Retention After Termination
We may retain:
- Backup Data: For up to 90 days in encrypted backups
- Legal Requirements: Data required by law for tax, accounting, or legal purposes
- Anonymized Analytics: Aggregated, non-identifiable usage data for service improvement
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
12.2 Informal Dispute Resolution
Before filing a formal claim, you agree to contact us at legal@hilainie.com to attempt to resolve the dispute informally. We commit to working in good faith to reach a mutually acceptable resolution.
12.3 Binding Arbitration
If informal resolution fails, you agree that disputes will be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) Consumer Arbitration Rules, rather than in court, except:
- Small claims court cases (under $10,000)
- Intellectual property disputes
- Injunctive relief to prevent irreparable harm
12.4 Class Action Waiver
You agree to resolve disputes with us on an individual basis only. You waive any right to:
- Participate in class action lawsuits
- Join class-wide arbitration
- Serve as a representative or member of a class action
12.5 Jurisdiction
To the extent arbitration does not apply, you agree to the exclusive jurisdiction of state and federal courts located in San Francisco County, California.
13. Miscellaneous Provisions
13.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Marar Ventures regarding the Service and supersede all prior agreements.
13.2 Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
13.3 Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
13.4 Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations without restriction, including to affiliates or in connection with a merger, acquisition, or sale of assets.
13.5 Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or internet/telecommunications failures.
13.6 Export Controls
You agree not to export, re-export, or transfer the App in violation of U.S. export laws and regulations or any other applicable export control laws.
13.7 Language
These Terms are provided in English. Any translations are for convenience only, and the English version controls in case of conflicts.
